EEE is an acronym for Electrical Electronic Equipment.

WEEE is an acronym for Waste Electrical Electronic Equipment.

Does your business conduct one of the following activities:-

If so it’s likely that you are a producer under the WEEE Regulations. (1)

The Waste Electronic and Electrical Equipment Regulations 2006 aim to reduce the amount of WEEE being disposed of and require EEE producers to pay for its reuse, recycling and recovery.(1)

  • Currently there is no deminimis, so any sales will make you obligated to join a Producer compliance scheme, plus register through them as a Producer with the Environment Agency.
  • A producer compliance scheme or ‘PCS’ is a service provided by a private company
  • They provide your obligations by reporting evidence of recycling, recovery and re-use of WEEE (1) They manage your obligations with you, reporting sales data to the EA on your behalf and they obtain evidence of compliance on your behalf to facilitate you meeting your obligations.

Fees of several hundred ££ apply annually to producers of EEE which are paid to the Environment Agency and their chosen PCS.

PCS’s charge fees for annual membership, for any evidence required, for any collection or treatment work carried out on your behalf and they collect your annual EA registration charges and pay these on to the EA.

Changes to legislation will mean huge savings for producers

WEEE RECAST

Following a consultation in our industry by the Department of Business Innovation and Skill it is highly likely that a significant change to the producers liability and obligation to report against their WEEE is about to take place.

In excess of 80% of all respondents to the BIS Consultation document, across all stakeholders (Producers, Local Authorities, compliance schemes, treatment providers, government departments and consultants) agreed that introducing a minimum threshold before it was required to join a Producer Compliance Scheme would be desireable. This level of support to an official consultation document around the WEEE re-cast cannot be ignored.

As of January 2014 the minimum weight of EEE Requiring Producers to be obligated to join a compliance scheme is likely to be set at 5000 KG’s; this de-minimiss level will remove a significant cost burden to small producers.(2). Small producers falling below 5000Kg’s pa will be able to report directly to the EA (as with battery regulations) for a nominal annual sum.

Other responsibilities upon B2B producers will remain unchanged, so Producers will need to remain conversant with the details of the regulations.

If you produce less EEE than the Deminimiss level,you are no longer obliged to Register with a Producer Compliance Scheme and thus will save the annual charges and significantly reduce your EA annual costs too. For many companies this saving can be thousands of pounds, but will be at least hundreds to all current small Producers.
